General Terms and Conditions – New OldSkool Huma

Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  • Entrepreneur: New OldSkool Huma, located at The Netherlands, reachable via info@newoldskoolhuma.com.

  • Consumer: The natural person who is not acting for purposes related to their trade, business, craft, or profession.

  • Distance contract: A contract concluded within the framework of a system organized by the entrepreneur for the remote sale of products, whereby exclusive use is made of one or more means of distance communication up to and including the moment the contract is concluded.

  • Cooling-off period: The period within which the consumer can exercise their right of withdrawal.

  • Right of withdrawal: The consumer's option to withdraw from the distance contract within the cooling-off period.


Article 2 – Applicability

These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.


Article 3 – The Offer

The offer contains a complete and accurate description of the products offered. Obvious errors or mistakes in the offer are not binding on the entrepreneur.


Article 4 – The Agreement

The agreement is concluded, subject to the provisions of paragraph 4, at the moment the consumer accepts the offer and complies with the conditions set.


Article 5 – Right of Withdrawal

The consumer may withdraw from a contract for the purchase of a product within a cooling-off period of 14 days without giving any reason.

The cooling-off period starts on the day after the consumer receives the product.


Article 6 – Consumer Obligations During the Cooling-Off Period

During the cooling-off period, the consumer shall handle the product and its packaging with care. The product may only be unpacked or used to the extent necessary to determine the nature, characteristics, and functioning of the product.


Article 7 – Exercising the Right of Withdrawal and Associated Costs

If the consumer exercises the right of withdrawal, they must notify the entrepreneur within the cooling-off period using the model withdrawal form or by making another unequivocal statement.

The consumer must return the product as soon as possible, but no later than 14 days from the day following the notification referred to in paragraph 1.

The consumer bears the direct costs of returning the product.


Article 8 – Obligations of the Entrepreneur Upon Withdrawal

The entrepreneur shall reimburse all payments made by the consumer, including any delivery charges imposed by the entrepreneur for the returned product, without delay and no later than 14 days after the day on which the consumer notifies the entrepreneur of the withdrawal.

The entrepreneur will use the same payment method that the consumer used, unless the consumer agrees to a different method.


Article 9 – Exclusion of the Right of Withdrawal

The right of withdrawal is excluded for products that are made to the consumer’s specifications, are clearly personal in nature, or by their nature cannot be returned.


Article 10 – The Price

During the validity period stated in the offer, the prices of the products offered will not be increased, except for price changes due to changes in VAT rates.


Article 11 – Compliance with the Agreement and Additional Warranty

The entrepreneur guarantees that the products comply with the agreement, the specifications stated in the offer, and reasonable standards of soundness and/or usability.


Article 12 – Delivery and Execution

The entrepreneur will take the utmost care in receiving and executing product orders.

The place of delivery is the address that the consumer has provided to the entrepreneur.


Article 13 – Payment

Unless otherwise agreed in the contract or additional terms, amounts owed by the consumer must be paid within 14 days after the start of the cooling-off period.

The consumer is obliged to immediately report any inaccuracies in payment details provided or stated to the entrepreneur.


Article 14 – Complaints Procedure

The entrepreneur has a sufficiently publicized complaints procedure and handles complaints in accordance with this procedure.

Complaints about the performance of the agreement must be submitted fully and clearly described to the entrepreneur within a reasonable time after the consumer has discovered the defects.


Article 15 – Disputes

Agreements between the entrepreneur and the consumer to which these general terms and conditions apply are governed exclusively by Dutch law.
